Deportation/Removal Defense
There is NO more important matter to a client than his/her immigration status
in the United States. Once deportation/removal proceedings commence, there is
an immediate and direct threat of not only losing one’s status, but the
possibility of imminent deportation/removal from the United States. As a former
Attorney-Advisor to the Immigration Courts of Miami, Orlando, Bradenton, Krome
Detention Center, and San Juan, Puerto Rico, Mr. Hujber has extensive experience
in deportation/removal matters. Mr. Hujber worked closely with the Immigration
Judges of each of these courts, and is intimately familiar with the manner in
which to present a strong and effective case before an Immigration Judge. One
of the first cases Mr. Hujber was involved in more than 12 years ago while working
for the Miami Immigration Court involved a good, hard-working family from Hungary,
a family that looked and sounded much like the family of Mr. Hujber. Mr. Hujber
was given the unique opportunity and responsibility of reviewing the hearings
in that matter, and drafting the final written decision GRANTING the relief
of suspension of deportation – and ultimately lawful permanent residency,
for the family in that matter. Mr. Hujber has drafted decisions in just about
every type of matter within the jurisdiction of the Immigration Court –
asylum, withholding of deportation/removal, issues of inadmissibility/deportability,
criminal waivers, suspension/cancellation of deportation/removal for both permanent
residents and non-permanent resident, derivative naturalization, voluntary departure,
and rescission (revoking permanent residence).
In his capacity with the Immigration Court, Mr. Hujber drafted hundreds of
final written decisions, decisions which direct affected the issue of whether
an individual could remain in the United States These decisions are critical
because aliens deported by the US may be ineligible to return for up to five
years, and in some cases, may never be allowed to return to the country again.
In his capacity with the Board of Immigration Appeals, Mr. Hujber similarly
drafted final written decision on hundreds of cases which came to this appeals
court from individuals all across the United States. It is important for clients
to know that they have a right to appeal essentially ANY decision of an Immigration

When a case is at this point in the process, it is especially important that
the case be very well prepared, that any and ALL legal issues are carefully
and thoroughly set forth in an appellate brief, and that all avenues of relief
are considered – Motions to Remand, Motions to Recuse, Motions to Reconsider,
et al. Having reviewed appellate cases during his tenure with the Board of Immigration
Appeals, Mr. Hujber is familiar with exactly what makes for a strong appeal,
what the appeals court expects, and how to thoroughly and aggressively advocate
for a client whose case is on appeal.
